Armenia: political prisoners calling for human rights Ombudsman’s resignation

I received a statement signed by 42 political prisoners strongly condemning Armenian human rights Ombudsman Armen Harutyunyan and demanding his resignation.

This statement follows pre-New Year holiday reports that some of the detainees were beaten and ill-treated in prison. Unsurprisingly, Justice minister denied the allegations. However, RFE/RL reported that Ombudsman Harutyunyan has expressed “serious concern” at allegations, having his aides visit the detainees. “A statement by the ombudsman’s office said Voskerchian insisted that he was punched and kicked by the commander of a Justice Ministry squad inspecting Nubarashen because of his political affiliation and activities. The oppositionists claimed that the incident occurred during searches conducted in his and other inmates’ prison cells, the statement said.”

I assume this strongly worded statement by political prisoners was influenced by reports of Ombudsman’s meeting with president Serj Sargsyan after which the latter instructed Justice minister to launch an “internal investigation”.

Political prisoners state that instead of demanding an immediate criminal investigation, Armenian Ombudsman backed an “internal investigation” which detainees believe is a way of cover-up. Statement by political prisoners also accuses Armenian Ombudsman in leniency re human rights violations in Armenia and him being involved in a “monitoring mission” of court hearings instead of clearly condemning them as politically motivated. Thus, the signatories argue that Ombudsman Harutyunyan is serving the authorities’ interests trying to avert Council of Europe sanctions.

Statement concludes by calling for human rights Ombudsman to resign, expressing “hope” that his follower would be different and true to the calling of human rights defender.

In the meantime, opposition Armenian National Congress issued a statement today strongly condemning reported beatings of imprisoned opposition activists and demanding criminal investigation. While criticising the Ombudsman, they stopped short of calling for his resignation.

In a separate statement, Armenian National Congress reminds that the “case of seven” court hearings of high profile oppositionists on coup charges will resume on 9 January, 12pm, at the Yerevan Shengavit district court building. They ask supporters to gather outside the court building to prevent possible provocations and turn the current trial into the “trial against authorities”.

I do agree that political prisoners have grounds for complaining of actions or inactions of Armenian Ombudsman. Armenian Ombudsman should have been more vocal in fighting human rights abuses in Armenia. However, let’s not forget that during emergency situation in March it was the only state institution which was able to deal with the human rights issues. Also, in following months, there were many occasions that the Ombudsman’s office helped in resolving human rights violations. Reports by Armenian Ombudsman on 1 March and following events were critical in making the case heard worldwide. By demanding his resignation now, political prisoners will not get desired justice. New Ombudsman will be appointed by the same authorities whose legitimacy is questioned by the opposition and detainees themselves. There is no way that they would trust this new Ombudsman more than the current one. Quite the contrary.

ՔԱՂԲԱՆՏԱՐԿՅԱԼՆԵՐԻ ՀԱՅՏԱՐԱՐՈՒԹՅՈՒՆԸ

Մենքª Հայաստանի Հանրապետության քաղբանտարկյալներս, վճռականորեն բողոքում ենք ՀՀ Մարդու իրավունքների պաշտպան Արմեն Հարությունյանիª վերջերս ծավալած, այդ պաշտոնին անհարիր գործողությունների ու վարքագծի դեմ:

Նա պարտավոր էր առաջինը համապատասխան գնահատական տալ Հայաստանում մոլեգնող քաղաքական վենդետային, ճանաչեր ու դատապարտեր վարչախմբի կողմից հազարավոր մարդկանց նկատմամբ քաղաքական հալածանքները, հարյուրից ավելի քաղաքական բանտարկյալների գոյության փաստը, արձագանքեր շինծու մեղադրանքներով հարյուրի չափ քաղաքական դատավարություններին, մարդու տարրական իրավունքների եւ ազատությունների ամենօրյա հարյուրավոր խախտումներին եւ այլն: Եթե այդ բանը նա չի արել, ապա պարտավոր էր դա անել գեթ այն բանից հետո, երբ Հայաստանում տասնյակ քաղբանտարկյալների գոյության փաստը վերջապես վավերացվել է ԵԽԽՎ Մարդու իրավունքների հանձնակատար Թոմաս Համմարբերգի զեկույցներում, ապա նաեւ ԵԽԽՎ Մոնիտորինգի կոմիտեի դեկտեմբերի 17-ի որոշումով:

Մինչդեռ դրանից հետո, Ա. Հարությունյանը, հակառակ իր կոչման ու պաշտոնական պարտականությունների կատարման, բացահայտ լծվել է վարչախմբի պաշտպանության ու նրա ապօրինությունների պարտակման գործին: Մասնավորապես, երբ նա հայտարարում է «7-ի գործով» դատավարությունը մոնիտորինգի ենթարկելու իր ծրագրի մասին, ընդամենը փորձ է անում բնական ու բնականոն համարել քաղբանտարկյալներ ճանաչված մարդկանց նկատմամբ արդեն իսկ հիմքում ապօրինի դատավարությունը, ժամանակ շահել վարչախմբի համար ու նրան մեկ անգամ եւս փրկել ԵԽԽՎ-ի սպասվող պատժամիջոցից: Դապապարտելի է ՀՀ Մարդու իրավունքների պաշտպանի հանցավոր վերաբերմունքը վերջերս կալանավայրերում քաղբանտարկյալների նկատմամբ ծավալված բռնությունների նկատմամբ: Փոխանակ պահանջելու անհապաղ քրեական գործեր հարուցել խայտառակ այդ փաստերով, նա ներգրավվում է ինչ-որ ծառայողական քննությունների մեջ: Նա նույնպիսի հանցավոր անտարբերություն է ցուցաբերում նաեւ այն դեպքում, երբ խոշտանգումների միջոցով քաղբանտարկյալներին ստիպում են ներման դիմումներ գրել ՀՀ նախագահի պաշտոնը զբաղեցնող անձի անունով, ինչով, ըստ էության, ընդունած կլինեն իրենց չգործած հանցանքը ու կորցրած կլինեն քաղբանտարկյալի կարգավիճակը:

Այսպիսով, Արմեն Հարությունյանը, ավազակապետական վարչախմբի համար վտանգավոր պահին ստանձնելով նրա փաստաբանի դերը, իր վրայից դեն է նետել ՀՀ Մարդու իրավունքների պաշտպանի քող-պատմուճանը ու ամբողջությամբ ներկայանում է ինչպես որ կաª որպես իշխանության դրածո, կամակատար մի խամաճիկ: Նրա միակ նպատակն այսօր Հայաստանում մարդու իրավունքների կոպտագույն խախտումների եւ քաղբանտարկյալների առկայության փաստերի կոծկումն է ու դրանով վարչախմբին սպասվող պատժամիջոցից զերծ պահելը: Ուստիեւ մենք Արմեն Հարությունյանին կոչ ենք անում հրաժարական տալ: Ուրիշ մեկը, թերեւս, կունենա տարրական պարկեշտություն ու նվազագույն տղամարդկությունª Մարդու իրավունքների պաշտպանի չափազանց կարեւոր ինստիտուտը չխայտառակելու համար:

RFE/RL: Armenian Ombudsman Rejects Opposition Criticism

Armenia’s state human rights defender, Armen Harutiunian, on Thursday dismissed opposition criticism of his recent activities as a manifestation of “neo-Bolshevik” thinking which he believes is shared by the government.

Harutiunian has come under opposition fire over his reaction to allegations that at least three of the opposition members arrested following last February’s presidential election were beaten up in Yerevan’s Nubarashen prison on December 23. Harutiunian expressed serious concern about the allegations, leading President Serzh Sarkisian to order a special inquiry at Nubarashen.

The ombudsman agreed to take part in it, a move that prompted criticism from former President Levon Ter-Petrosian’s Armenian National Congress (HAK). In a statement on Wednesday, the opposition alliance dismissed the probe as a smokescreen for a government cover-up of the alleged torture. It said the authorities should instead launch criminal proceedings against the prison administration.

A separate statement issued by 42 arrested oppositionists went further, branding Harutiunian as an advocate of the “kleptocratic regime” and demanding his resignation. “His main goal today is to cover up blatant human rights violations and the existence of political prisoners in Armenia and thereby spare the regime sanctions [by the Council of Europe,]” they charged.

The pro-Ter-Petrosian daily “Haykakan Zhamanak” claimed on Thursday that Harutiunian has been offered the post of justice minister or prosecutor-general in return for helping the Armenian authorities avoid the sanctions.

Harutiunian brushed aside the allegations. “I just don’t know how I can influence the Council of Europe to avoid imposing sanctions,” he told RFE/RL. “May be they [the opposition] know.”

Harutiunian said that both the opposition and the authorities have put pressure on him since the March 1 deadly clashes in Yerevan. The ombudsman strongly questioned the official version of those events at the time, incurring the ire of outgoing President Robert Kocharian. Armenia’s Office of the Prosecutor-General and Justice Ministry subsequently issued lengthy reports designed to challenge his judgment and justify the use of force against opposition protesters.

Harutiunian has also been critical of the arrests and controversial trials of dozens of Ter-Petrosian loyalists, while declining to refer to them as political prisoners. “In an atmosphere of political intolerance and mutual hatred among various political camps, it is normal that the prosecutor’s office says that the human rights defender must be prosecuted and then some time later the Armenian National Congress demands that he resign,” he said on Thursday. “I am used to this to neo-Bolshevik notion that if your opinion doesn’t correspond to ours then you are a bad guy,” he added.

The HAK clarified later on Thursday that unlike most of the jailed oppositionists, it did not demand Harutiunian’s resignation. A leading member of the opposition alliance, Levon Zurabian, also told RFE/RL that he has received a letter from another detainee, Vardges Gaspari, claiming that the latter too was ill-treated by security officers on December 23.

“This is related to the fact that the authorities are putting pressure on political prisoners to send pardon requests to the presidential administration,” said Zurabian, “This practice is unacceptable.”

The authorities did not immediately react to the claims. A spokesman for the Justice Ministry department managing Armenia’s prisons said only that the official inquiry into the alleged Nubarashen beatings is still in progress.

Harutyunyan's obviously been between a rock and a very hard place for many months. With the political prisoners' approach, unfortunately, the more important story is being buried, which is the mistreatment and even possible torture of prisoners to get them to ask for pardons, which can then be shown as "evidence" of their guilt. The ANC statement is a more reasoned approach; perhaps a more empassioned and targeted plea for international human rights organizations to investigate the prisoners' allegations needs to be made.

I may sound quite subjective but I have never trusted the Ombutsman as many others who have had a chance to work with him for some time, a slippery person, nicknamed "Dollar Armen" long ago.
